Terms and Condition Policy

The Terms and Conditions set out below apply to all transactions between us. These terms and conditions will not affect your statutory rights.
Company Details.
Carole Hutchings Fine Art (CHFA).
Purchase and Payment.
All Orders placed on my website will receive a confirmation e-mail of the transaction. It is the customer’s responsibility to check any email filters that may interfere with my communication to you. All goods are sold subject to availability. In the event that I am unable to supply the goods, I will inform you by telephone or email of this as soon as possible, normally within 48 hours. A full refund will be given where you have already paid for the goods and the transaction will be cancelled. Should you wish to choose another item of the same value this is acceptable. Payment will only be accepted in the currency and by the means and method set out in my communication with you.
Postage and Packing.
Prices do not include postage and packing which will be charged as an additional cost on all orders that are applicable.
Delivery.
As each order is dealt with on an individual basis, items are usually dispatched within 10 working days or less. Please advise us if you do not receive your item(s) so that we can trace the parcel. Delays occasionally take place due to circumstances beyond our control, including courier and/or postal problems and this will affect delivery times.
Prices.
All prices quoted on this site are in UK pounds. Delivery will be charged when payment is taken. Please note all delivery charges will be quoted on request. For all prints requiring overseas delivery, these can be sent mounted only owing to excessive charges for glass and the high risk of damage in transit. The price you pay is the price displayed on this website at the time I receive your order, plus the cost of Postage and Packing. However, errors and omissions are excluded.
Returns.
Any damage fault defect or non-compliance with the description in respect of the goods must be notified to us within 7 days of delivery in writing or by email. If it is not so notified, you will be deemed to have accepted the goods in all respects and I will not accept their return. In some cases, I may require you to return the defective goods to me at my cost. Where there is a valid claim I may at my option replace the goods free of charge or refund the price for the goods in question, subject to the return of the supplied goods to me. I will refund to you the reasonable costs incurred for the postage of those goods but will have no further liability to you.
Data Protection.
I will take all reasonable precautions to keep the details of your address, order and payment secure and the customer must also do the same. Unless I am negligent, I cannot be held liable for any loss or damages caused as a result of unauthorized access to information provided by you. If I have reason to suspect that your details have been obtained fraudulently from me, we will endeavour to let you know as soon as I can. The Data Protection Act 1998 applies. Limitation on Liability.
I make no warranty as to the accuracy of the information I place on my website. The extent of my liability for any breach of these Terms and Conditions shall be limited to the value of the goods ordered by you. Nothing in these Terms and Conditions shall exclude or limit my liability for death or personal injury as a result of my negligence.
Customs.
International Tax, Customs and Import Duties are not included in the price. You are solely responsible for payment of any such charges.
Copyright and Trade Marks.
Copyright and all intellectual property rights in the goods are reserved and excluded and either belong to me. All content, compilations of content and software used on this website including text, graphics, logos, images data compilation and software is my property or that of my content suppliers and is protected by United Kingdom and international copyright and database right laws. You may not extract and/or re-utilize the whole or parts of the contents of the website and/or create or publish your own database or website that contains substantial parts of this website.
Events beyond our reasonable control.
I will not be held responsible for any delay or failure to comply with my obligations under these conditions if the delay or failure arises from any cause which is beyond my reasonable control.
Applicable Law and Jurisdiction.
The contract shall be deemed to be made in England. All contracts made between me and the Customer shall be governed by the laws of England and any dispute arising therein shall be subject to the exclusive jurisdiction of the English courts.
